GENERAL TERMS AND CONDITIONS:

ORGANISATION AND ADMINISTRATION

Eleven Magazine Limited (hereby referred to as ‘Eleven’) is a private limited company by shares registered in England No.8666748 with registered offices at: Building 6000, Langstone Technology Park, Langstone Road, Havant, Hampshire, PO9 1SA, UK.

Eleven reserves the right to assign any judges, agents or other authorized administrator to administer its competitions/events/exhibitions/publications/projects, including making any decision or exercising such at its discretion.

OVER-RULING

The terms and conditions heron stated are the official terms and conditions of Eleven and take precedent on any other terms and conditions which may be found in briefs in the event of disputes.

COMPETITION/EVENT/PROJECT SPECIFIC TERMS AND CONDITIONS:

ELIGIBILITY

Eleven’s competitions/events/exhibitions/publications/projects are open to anyone aged 18 and over. Younger entrants or group of students under 18 years of age must be lead by someone aged 18 or their tutor 18 or over.

By entering Eleven’s competitions/events/exhibitions/publications/projects, any and all entrants, participants, and submissions agree in full to these Terms and Conditions and as referred “herein”.

Employees of Eleven, member of the judging panel and their employees, associates, or partners are prohibited from entering the competition. They can and are encouraged to submit ideas for a special mention but cannot win or be part of the formal competition.

SUBMISSION

Entrants may either make a submission individually or as a team of up to four individuals.

All participants in Eleven’s competitions/events/exhibitions/publications/projects are prohibited from sale, assignment or transfer of any of their submission rights to third parties.

Student entrants would be required to prove of their status for any student only competitions/events/exhibitions/publications/projects and the same would be true for professional only competitions/events/exhibitions/publications/projects should the submission be selected as one of the winning entrants.

All submissions must strictly conform to Eleven’s Terms and Conditions as well as any additional Terms and Conditions and the Rules and Guidelines set by Eleven in the individual Competition Brief.

Once the final submissions are sent, no additional edits or change can be made to that submission.

By entering the competitions/events/exhibitions/publications/projects, the entrant acknowledges and accepts that all aspects of any submission narrative, description, details, images, illustration and animation may be used fully by Eleven.

PERSONAL INFORMATION

Eleven will not disclosed or sell any personal information submitted by entrants or participants to any third parties.

OWNERSHIP, INTELLECTUAL PROPERTY AND COPYRIGHT

All competitions, all briefs, all merchandise, all linked materials (both conceptual or physical) and all spine-off events mentioned at the time of the competition or which might arise from it in future directly linked to Eleven’s competitions are, in their entirety, the intellectual, legal and copyright sole property of Eleven unless otherwise agreed by in writing.

By submitting an entry to Eleven’s competitions, the entrant agrees to fully share the intellectual property of the entry with Eleven.

By submitting any entry to Eleven’s competitions, the author of the entry agrees to fully share the ownership of copyright with Eleven.

By submitting any entry to Eleven’s competitions, the author of the entry agrees that any future endeavours which arise from their entry subsequent to the competition submission (i.e. development of the project, prototype, production, events, competitions, publications, etc) have to agreement upon with Eleven in writing, as Eleven is the sole owners of the competition’s intellectual, legal and copyright property and is co-owners of the copyright and intellectual property of the entry itself.

Eleven reserves the right to use any material submitted to the competitions/events/exhibitions/publications/projects for advertising, promotions, exhibitions, or however they see fit for the promotion of their business. This may include publication and marketing materials. Any third party that wishes to use or publish any competition/event/exhibition/publication/project entries or any related material must first get written consent from Eleven.

No entrants or participants shall receive or be entitled to receive any payment in any form for submissions or for granting Eleven any right herein, other than for being selected as one of the awarded entries eligible to cash prizes in the competition.

In entering the competitions/events/exhibitions/publications/projects, the registrant and all team members recognise the event as the intellectual property of Eleven and agree to credit the organisation by name in any future use of their project.

Eleven shall treat an entry or submission as being eligible to enter the competitions/events/exhibitions/publications/projects under United Kingdom Copyright law.

Any breach of copyright, intellectual property and/or ownership rights will be immediately persecuted by law.

COMPETITION/EVENT DISQUALIFICATION

Submission which do not meet or comply with the submission guidelines or found to contain identifying signs or marks that may, in any way, contribute to identifying the entrant – and thus breaching the anonymity of the projects at judging stage – shall be disqualified imediatly.

In the event of disqualifications, Eleven is under no obligation to notify the entrant or participant of the disqualification of their entry or submission.

All Submissions after the closing date for a particular competition/event will be automatically disqualified.

Eleven reserves thee right to disqualify any submission deemed as offensive, pornographic, damaging or inappropriate for publishing.

No refund will be made available in the event of disqualification.

PLAGURISM

There will be no tolerance to plagiarism. Unless otherwise stated through the use of image or text credit, the submissions must be original work of the participant. In submitting the entries, participants automatically agree that the work they have submit is their work and their work alone, unless otherwise credited and cited clearly and fully.

Any entry which is found guilty of plagiarism will be disqualified immediately, reported, and banned for entering any future competitions/events/exhibitions/publications/projects or events hosted by Eleven or any of its partners.

PARTICIPANTS CANCELLATION / WITHDRAWAL

In the event of a participant’s decision to cancel or withdraw from the competitions/events/exhibitions/publications/projects, no refund will be made available.

Exceptional circumstances for cancellation or withdrawals should be made available to eleven in writing. Eleven will consider these circumstances at their discretion.

CHANGES

Eleven reserves the right to cancel or suspend or alter the rules of their competitions/events/exhibitions/publications/projects at any stage if deemed necessary and if circumstances arise outside of its control.

Any participant will be notified by Eleven should any changes occur during the running of their competitions/events/exhibitions/publications/projects.

COMPENSATION

Any compensation will be handled by Eleven and will be in Great British Pounds (£ / GBP) unless otherwise stated and agreed upon in writing.

WINNER SELECTION / JURY’S DECISION 

With the exception of the People’s Choice Awards, which is determined by the general public, awarded entries are selected by the jury, who hold the final say on the matter.

In the event that a selected winning entry cannot accept, receive or are ineligible for the prize for any reason, the prize shall be awarded to the next highest rated entry from the top short-listed or remaining entries that meet the winning requirement.

Eleven’s association with the competition judges does not imply any legal association, affiliation, contract or partnership in any way shape or form.

COMPETITION INTEGRITY

All competition entries are anonymous; ensuring the jury deliberates on the entries solely on quality of the entrant’s final proposal.

Eleven undertakes to scrupulously protect the integrity of its competitions by:

  • A unique entrant registration number by which each submission received will be administered, organized, processed and evaluated. This means that the digital submissions received by Eleven from the entrants will be stored under their registration numbers to assure the anonymity of the judging processes.
  • Enforcing the rules that besides the registration number, all illustrations or images accompanying any submission shall be devoid of any marks, logos, symbols or sign that may identify its authority.

Any infringement of these rules will lead to immediate disqualification.

The jury or judging panel will only be made aware of the entrant’s identities only after the evaluation stages and winners are selected.

COMMUNICATIONS

All competition/event/exhibition/publication/project related communications between participants and the organizers are to be directed solely to Eleven through email on info@eleven-magazine.com

Any attempt at contacting any member of the jury panel in any way will result in the entrants immediate disqualification.

PRIZES

Prizes awarded will be as advertised for each competition.

Eleven reserves the right to add or amend additional prizes.

All prizes are in Great British Pounds (£ / GBP) unless otherwise stated or agreed upon in writing.

Any imposed government regulations or economic sanctions by the United Kingdom that prohibit monetary transfer to a winner’s country of residence shall result in the prize money shall not be awarded to the entrant and at Eleven’s discretion may award it to the next highest ranked entry, however will mention the original winning entry in its list of winners.

PUBLICATION

Eleven reserves the right to publish any materials derived from their competitions/events/exhibitions/projects in whole or in part, or use them in any way it sees fit in connection with this website or its competitions and events without permission of the entrant or payment for such use, subject to the provisions of the Data Protection Act 1998.

REGISTRATION FEE AND ASSOCIATED COST

There is a registration fee for competitions on the website and all costs and disbursements incurred by entrants in preparing a submission or entry are the sole responsibility of the entrant.

All registration or submission fees are non-refundable and non-transferable once an entry is made.

Fees may be wavered, amended, reduced or discounted subject to Eleven’s discretion only.

Registration fees are in Great British Pounds (£ / GBP) unless otherwise stated or agreed upon in writing.

PUBLICITY AND PROMOTITON

Winners agree to and shall, upon request at reasonable notice, participate in publicity or promotional activity surrounding the competitions/events/exhibitions/publications/projects such as interviews, personally or otherwise. Each opportunity shall be taken on merit and the entrant or participant shall have the right to decline any such opportunity.

SPIN-OFF OR FUTURE EVENTS

Any mention to events, publications, exhibitions, and projects organised by Eleven beyond the actual competition/event/project are at the discretion of Eleven.

Eleven reserves the full right to change or cancel any such future event at their own discretion should they deem it necessary.

PARTNERSHIPS

In the event of partnerships, any information, documents, reports, ideas, communication divulged by Eleven to its potential partners is confidential and remains the sole property of Eleven until a binary contract is agreed upon and signed between the partnership.

In the event a binary contract is not reached, Eleven reserves the right to withdraw from any partnership at their discretion. All materials provided by Eleven remain confidential and the sole property of Eleven and cannot be used for future endeavours in future partnerships in which Eleven is either part of and/or remunerated and has agreed upon in writing.

LIABILITY

Entrant agrees to release, indemnify, defend any party from any liability, any claim for damages, and/or law suit for or by reason of the mentioned submission as a result of any submission, revision, alteration or similar thereof.

The entrants also acknowledges and agrees and therefore covenants not to sue or make any claim against any party related to an entrant’s submission or any individual participation or involvement in the competitions/events/exhibitions/publications/projects in any way whatsoever, or any use thereof, and therefore:

  1. Under no circumstances shall or can the Entrant be entitled to any award for any loss or any damages, which include attorneys’ fees.
  2. Any dispute, claim and legal action arising from or connected with this competitions/events/exhibitions/publications/projects, or any prizes awarded or potentially awarded therein, shall be resolved without resort to any form of legal action or class action.
  3. Should an entrant choose to bring a claim against Eleven or it’s agents the entrant shall pay the Eleven or any party’s reasonable attorneys’ fees and its legal costs arising from the claim should it fail.
  4. Nothing herein will constitute a waiver of the entrants or participant legal rights or any rights any party may have to take against the entrant or participant.

Eleven shall not be liable for any law suit or claim against any of it’s judges or selector panel emanating from their professional conduct or otherwise.

AMENDMENTS

Eleven reserves the right to amend these Terms and Conditions at any time without notice.

GOVERNING LAW

These Terms and Conditions are governed by and in accordance with the laws of England and Wales.

Any breach of these terms and conditions are punishable by law and will result in immediate further action being taken on the part of Eleven.

You agree that you will only use our web site in a way which is consistent with our terms and conditions. We reserve the right to modify or withdraw this site at any time without liability.

AMENDMENTS

Eleven reserves the right to amend these Terms and Conditions at any time without notice.

PRIVACY POLICY 

Eleven is committed to protecting your privacy and aware how important it is to you. All information collected on our site is only used to process and administer your competition/event/exhibition/publication/project submission (in accordance to the full terms & conditions) and to provide you with a more personalised visit and experience to the site.

COPYRIGHT PROTECTION

All registered trademarks, symbols or words are owned, protected and property of the respective trademark their owners. Where no registered trademarks, symbols or words are displayed, they are automatically the ownership and property of Eleven.

INFORMATION COLLECTION

We collect either directly from you when you register with our site or through cookies which are information that are stored by your browser on your computer.

Cookies are small text files that identify your computer to our server and enable us to enhance your visit and shopping experience with us. These cookies record information on viewed pages or adverts, frequency of visited pages and general navigation of our site. These cookies in no way allow us access to your computer and do not store any personal or payment details.

The personal information collected is mainly used for competition/event/exhibition/publication/project submission administration and processing (in accordance to the full terms & conditions)

We may sometimes also monitor site usage, shopping and traffic patterns to improve the functionality of the site, products and services.

Details collected upon registration will include your name, email address, postal address and telephone number (where necessary) and by registering with Eleven you agree to the terms and conditions. Your details may also be used to keep you informed of future competitions/events/exhibitions/publications/projects, products, services or promotions unless otherwise requested.

DATA PROTECTION

Eleven will hold and use your personal data strictly in accordance with UK data protection legislation.

We will comply with the Data Protection Acts 1984 and 1998.

UNREGISTER

Should you wish for us to no longer hold or use your personal details then you have the option to unregister at any time. To do this please contact us at unsubscribe@eleven-magazine.com stating your name and the registered email address you wish to unsubscribe.

NOTIFICATION OF CHANGES 

 Any changes to our privacy policy or how we collect and use your personal information will be reflected on the site and registered users will be informed and given the opportunity to disagree or agree with this change.

SECURITY POLICY

Eleven is aware of how important it is to be able to browse safely and securely which is why all sensitive information is collected and process through a secure system. When we require you to enter sensitive information such as payment card details, you will be taken to a secure system and you should see the unbroken key or locked padlock icon at the bottom of your browser and also ‘https’ at the address bar, which indicates a secure system.

Eleven reserves the rights to discontinue any of its promotions at anytime without warning or notice.

LIMITATION OF LIABILITY

Eleven disclaim any and all warranties or association of any kind (expressed or implied) in relation to the competitions/events/exhibitions/publications/projects or products or services on this site.

GENERAL INDEMNITY

 You agree to indemnify Eleven fully from and against all claims, liability, damages, losses, costs and expenses, legal fees arising out of any breach of these conditions by you or any other liability arising out of your use of this site.

GOVERNING LAW

These Terms and Conditions are governed by and in accordance with the laws of England and Wales.
